Welcome to GAMECHARGE SDN BHD! These Terms of Use ("Terms") govern your access to and use of our website, www.gamecharge.net (the "Site"), and the services offered through the Site, including the purchase of digital game keys, software, and related digital content (collectively, the "Services").

By accessing or using our Site and Services, you ("User," "you," or "your") agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree to all of these Terms, do not access or use our Site or Services.  

 

1. Acceptance of Terms By creating an account, making a purchase, or otherwise accessing or using the Services, you affirm that you are of legal age to enter into these Terms, or, if you are not, that you have obtained parental or guardian consent to enter into these Terms. You also affirm that you are not a person barred from receiving Services under the laws of Malaysia or other applicable jurisdictions.

  • Account Suspension/Termination: GAMECHARGE SDN BHD reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to your violation of these Terms or inactivity.

3. Use of Services and Products

  • License: Upon purchase of a game key or other digital content, GAMECHARGE SDN BHD grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the purchased product for your personal, non-commercial use, subject to the terms and conditions of the respective game's End User License Agreement (EULA) and any other applicable terms from the game publisher or developer.
  • Restrictions: You agree not to:
    • Use the Services or products for any illegal or unauthorized purpose.
    • Resell, distribute, or otherwise commercially exploit any products purchased through the Services without express permission from the rights holder.
    • Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of any software provided through the Services.
    • Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on any products or on the Site.
    • Engage in any activity that interferes with or disrupts the Services or the servers and networks connected to the Services.  

4. Purchases and Payments

  • Product Descriptions: We strive to provide accurate descriptions of the games and digital content offered on our Site. However, we do not warrant that product descriptions or other content are accurate, complete, reliable, current, or error-free.  
  • Pricing: All prices are listed in USD by default and auto convert based on end users' choice. Prices and availability of products are subject to change without notice. We are not responsible for typographical errors in pricing.  
  • Payment: You agree to pay all fees and applicable taxes incurred by you or anyone using an account registered to you. We may use third-party payment processors to handle payment transactions. Your use of such third-party payment services is subject to their terms and conditions.  
  • Order Confirmation: After you place an order, you will receive an email confirming your purchase. This email confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason.

  • Refunds: Due to the digital nature of our products, all sales are generally final. Refunds may be considered on a case-by-case basis at our sole discretion, and subject to applicable law and the policies of the relevant game publisher or platform. 6. User Conduct You agree not to use the Site or Services to:

  • Upload, post, email, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.  
  • Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Service.  
  • Upload, post, email, transmit, or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships.  
  • Upload, post, email, transmit, or otherwise make available any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.  
  • Upload, post, email, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.  
  • Upload, post, email, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.  
  • Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service.

By using our Site and Services, you consent to the collection and use of your information as described in our Privacy Policy.  

 

8. Disclaimers of Warranties THE SITE AND SERVICES, AND ALL PRODUCTS, CONTENT, AND MATERIALS PROVIDED THROUGH THEM, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GAMECHARGE SDN BHD MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR SERVICES OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE OR SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SITE AND SERVICES IS AT YOUR SOLE RISK.  

 

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, GAMECHARGE SDN BHD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. GAMECHARGE SDN BHD DOES NOT WARRANT THAT THE SITE, SERVICES, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE OR SERVICES, ITS SERVERS, OR ELECTRONIC COMMUNICATIONS SENT FROM GAMECHARGE SDN BHD ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.  

 

9. Limitation of Liability TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, GAMECHARGE SDN BHD WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SITE OR SERVICES, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE OR SERVICES, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.  

 

IN NO EVENT SHALL GAMECHARGE SDN BHD'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.  

 

10. Third-Party Links and Services The Site or Services may contain links to third-party websites or services that are not owned or controlled by GAMECHARGE SDN BHD. GAMECHARGE SDN BHD has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that GAMECHARGE SDN BHD shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

11. Modifications to Terms GAMECHARGE SDN BHD reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site or Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.  

 

12. Governing Law and Dispute Resolution These Terms and any action related thereto will be governed by the laws of Malaysia without regard to its conflict of laws provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Kuala Lumpur, Malaysia) before one arbitrator. The language of the arbitration shall be English. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.

Alternatively, you agree that any legal action or proceeding between GAMECHARGE SDN BHD and you for any purpose concerning these Terms or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Malaysia.  

 

13. Termination GAMECHARGE SDN BHD may terminate or suspend your access to all or part of the Site and Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.  

 

14. Age Restrictions and COPPA Our Services are not directed to children under the age of 13 (or the relevant age of consent in your jurisdiction). We do not knowingly collect personal information from children under 13. If you are a parent or guardian and you are aware that your child has provided us with personal information without your consent, please contact us. If we become aware that we have collected personal information from children without verification of parental consent, we take steps to remove that information from our servers. If you are under 18, you must have your parent or legal guardian's permission to use our Services and make purchases.  

 

15. Digital Millennium Copyright Act (DMCA) If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please notify GAMECHARGE SDN BHD's copyright agent as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information in writing:

16. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy and any other legal notices published by GAMECHARGE SDN BHD on the Site, shall constitute the entire agreement between you and GAMECHARGE SDN BHD concerning the Services.
  • Severability: If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
  • No Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and GAMECHARGE SDN BHD's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.  
  • Assignment: These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by GAMECHARGE SDN BHD without restriction.  
  • Force Majeure: GAMECHARGE SDN BHD shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond GAMECHARGE SDN BHD's reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation.
